By accessing or using AskSonya.ai (the "Platform"), including any of its tools, features, content, books, AI services, consultation offerings, or downloadable resources, you ("User," "you," or "your") agree to be legally bound by these Terms of Use ("Terms"). These Terms form a binding legal agreement between you and AskSonya.ai, operated by Sonya M., MLS(ASCP) ("we," "us," or "our").
If you do not agree to these Terms in their entirety, you must immediately stop using the Platform. Your continued use of any part of AskSonya.ai constitutes your ongoing acceptance of these Terms and any updates to them.
These Terms apply to all users of the Platform, including visitors, newsletter subscribers, tool users, AI chat users, book purchasers, and consultation clients. They supplement — and do not replace — our Privacy Policy, which is incorporated herein by reference.
Age Requirement: You must be at least 18 years of age to use AskSonya.ai. By using this Platform, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use this Platform under any circumstances.
As used throughout these Terms, the following words have the meanings below:

| "Lab Content" | Any laboratory result values, medical reports, health data, or clinical documents that a user voluntarily submits to the Platform for educational analysis. |
| "Third-Party API" | Specifically, the Anthropic Claude API used to power the AI Features, accessed using a user-provided API key. |
| "Sonya M." | Sonya M., MLS(ASCP) — Clinical Laboratory Scientist and author, the creator and operator of AskSonya.ai. |
AskSonya.ai offers the following services and features, each subject to these Terms:
We reserve the right to modify, suspend, discontinue, or add any service or feature at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

AskSonya.ai IS NOT: a medical provider, physician, nurse practitioner, registered dietitian, licensed therapist, pharmacist, HIPAA-covered entity, telehealth service, clinical decision support system, or any form of regulated healthcare service.

Laboratory Reference Ranges: Reference ranges provided on this Platform are general educational values commonly used in clinical practice. They may differ from the ranges used by your specific laboratory, your physician's clinical judgment, or your individual health context. Always refer to the reference ranges provided by the laboratory that performed your testing and discuss results with your physician.
If you have concerns about any laboratory result, symptom, or health condition, contact your licensed healthcare provider immediately. If you believe you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.
By using this Platform, you expressly acknowledge and accept that you are using it for educational purposes only, and that you will not use any information obtained from AskSonya.ai as a substitute for professional medical advice, diagnosis, or treatment.
The AI Features on AskSonya.ai are powered by the Anthropic Claude API and are subject to the following additional terms, in addition to all other provisions of these Terms of Use.
5.1 Nature of AI Output
AI Output is generated by a large language model and is inherently probabilistic and imperfect. AI Output may contain errors, inaccuracies, outdated information, or content that is irrelevant to your specific clinical situation. AI Output must never be used as the basis for any medical decision.

To access the AI Features, you must provide your own Anthropic API key. By providing your API key, you:

AI Accuracy Limitation: The AI Features may present information confidently that is incorrect, incomplete, or inapplicable to your specific situation. The educational quality of AI Output depends heavily on the quality and completeness of information you provide, the current capabilities of the underlying model, and factors beyond our control. Always verify any specific health claim with a qualified professional.

The AI functionality is provided by Anthropic, PBC, a separate company with its own terms of service and privacy policy. AskSonya.ai is not responsible for the performance, availability, accuracy, or any other characteristic of Anthropic's services. By using the AI Features, you also agree to Anthropic's Usage Policy.
Paid consultation sessions with Sonya M., MLS(ASCP) are subject to the following terms in addition to all other provisions of these Terms of Use.
6.1 Scope of Consultations
All consultations are strictly health literacy and education sessions. Sonya M. acts as a health educator and clinical laboratory science consultant, not as your treating physician, licensed therapist, or healthcare provider of any kind. No doctor-patient relationship is created by a consultation.

6.2 Payment, Cancellation & Refunds
Consultation sessions are billed at the rates listed on the booking page. Payments are processed securely via Stripe. Sessions cancelled more than 24 hours in advance receive a full refund. Sessions cancelled within 24 hours receive a 50% refund. No-shows are non-refundable. AskSonya.ai reserves the right to cancel any session that cannot reasonably be conducted within the educational scope described above, with a full refund issued to the client.
6.3 Recording
Sessions may not be recorded by the client without the prior written consent of Sonya M. AskSonya.ai may record sessions for quality assurance and educational improvement purposes; clients will be informed if recording is initiated.
All content on AskSonya.ai is the intellectual property of Sonya M. and AskSonya.ai unless otherwise indicated. This includes:
Permitted Uses: You may access and use the Platform's content for your own personal, non-commercial, educational purposes. You may share links to Platform pages. You may quote brief passages from Platform content for commentary or review, with attribution.
Prohibited Uses of IP: You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from this Platform for commercial purposes, without the express prior written permission of AskSonya.ai.
AI Output & Intellectual Property: AI Output generated during your session is provided for your personal educational use. AskSonya.ai makes no claim to AI Output you generate, but you may not commercially exploit, publish, or distribute AI Output in ways that misrepresent it as professional medical advice or as the independent professional work of Sonya M.
You agree that you will not use AskSonya.ai for any of the following purposes:
Violation of these prohibited use restrictions may result in immediate termination of your access to the Platform, potential legal action, and reporting to relevant authorities where applicable.
When you use AskSonya.ai, you are solely responsible for:
Health Data You Submit: You represent and warrant that any laboratory results, health information, or documents you submit to the Platform are either your own or that of a person who has given you explicit written authorization to submit their health data for educational purposes. You further agree that you will remove personally identifying information from any documents before submission.
Accuracy of Input: The quality and accuracy of AI Output depends substantially on the accuracy of information you provide. Inaccurate, incomplete, or misleading inputs may result in AI Output that is unhelpful, incorrect, or potentially harmful if misapplied. AskSonya.ai bears no responsibility for AI Output resulting from inaccurate user inputs.
AskSonya.ai integrates with and links to several third-party services. Your use of third-party services is governed by their respective terms of service and privacy policies, not by these Terms of Use.
AskSonya.ai is not responsible for the availability, accuracy, content, products, or services of any third-party website or service. Links to third-party sites do not constitute an endorsement of those sites or their content.
THE PLATFORM AND ALL ITS CONTENT, FEATURES, SERVICES, AND AI OUTPUT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by applicable law, AskSonya.ai expressly disclaims all warranties, including but not limited to:
AskSonya.ai makes no warranty, representation, or guarantee regarding the results that may be obtained from use of the Platform, or that any errors in the Platform will be corrected. We specifically disclaim all responsibility for any clinical decisions made by users based on Platform content.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ASKSONYA.AI, SONYA M., MLS(ASCP), AND THEIR AFFILIATES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, MEDICAL OUTCOMES, PERSONAL INJURY, OR OTHER INTANGIBLE LOSSES — ARISING FROM YOUR USE OF THE PLATFORM, AI FEATURES, CONTENT, TOOLS, OR CONSULTATION SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Where limitation of liability is not permitted by applicable law, our liability is limited to the maximum extent permitted by law. In no event shall our total liability to you for all claims arising from or related to the Platform exceed the greater of: (a) the total amount you paid to AskSonya.ai in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).
Health Decision Liability: You expressly acknowledge that any health decision you make — including decisions about medications, treatments, laboratory testing, supplementation, lifestyle changes, or whether to seek medical care — is made solely at your own risk. AskSonya.ai bears no responsibility or liability for any such decision, regardless of whether content from this Platform was considered in making it.
You agree to defend, indemnify, and hold harmless AskSonya.ai, Sonya M., MLS(ASCP), and their respective affiliates, officers, agents, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

AskSonya.ai reserves the right, in its sole discretion, to terminate or restrict your access to the Platform, any feature, or any service at any time, with or without notice, for any reason, including but not limited to:
Upon termination, your right to access and use the Platform immediately ceases. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

Governing Law: These Terms and any dispute arising from or related to them or the Platform shall be governed by and construed in accordance with the laws of the United States and the state in which AskSonya.ai is primarily operated, without giving effect to any choice of law or conflict of law provisions.
Dispute Resolution — Informal First: Before initiating any formal legal proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for a period of thirty (30) days. Many concerns can be resolved quickly and amicably through direct communication.
Binding Arbitration: If an informal resolution cannot be reached, any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform — except for claims for injunctive relief to protect intellectual property — shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in a court of law.
Class Action Waiver: To the fullest extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration against AskSonya.ai related to your use of the Platform.
Exceptions: Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.
We reserve the right to modify these Terms of Use at any time. When we do, we will:

Future versions may include paid subscriptions, managed AI access (removing the need for a personal API key), premium dashboards, and additional services. These Terms will be updated when such services are introduced, and you will have the opportunity to review and accept revised Terms before using new paid features.
